Terms
Version 1.0. Effective 20 August 2026.
1. Agreement
These Terms govern access to File Transfer - Tool - by Alexandru Jungean at https://transfer.alexjungean.com (the “service”), provided by Alexandru Jungean (the “provider”). By using the site, creating a transfer, opening a capability link, previewing or downloading a file, or submitting a report, you agree to these Terms, the Privacy Policy, the Cookie Policy, and the Acceptable Use Policy. If you do not agree, do not use the service.
The English text is the binding language. A Romanian translation is provided for convenience. The service is offered without charge. There is no paid consumer contract and no distance-selling of goods.
2. The service
The service lets the operator create an expiring transfer, upload files to private object storage, finalize them, and share independent download and delete capabilities. Recipients may inspect safe metadata, preview original raster image bytes when the type is allowed, and download. Anyone with the delete proof may delete after confirmation.
The service does not include accounts, email delivery, payments, teams, or server-side ZIP archives.
3. Eligibility and operator-only create
You must be at least 16 years old, or the digital-consent age in your country if higher, and legally able to enter this agreement. Only the operator may create, upload, or finalize a transfer. Create requires a server secret and a session cookie, not an account. A stranger cannot host a payload on this origin.
4. Capability links and passwords
A public ID may appear in a path. Download and delete proofs live only in the URL fragment and are sent after page load as JSON proof. Treat share links as secret. Anyone who has the download proof (and the password, if set) can inspect, preview, and download until authorization ends. Anyone who has the delete proof can delete the transfer. An optional password is an extra gate. It is not end-to-end encryption of the stored files.
Do not put proofs in email, tickets, or chat. Do not ask the provider to recover a lost proof.
5. Your responsibilities
- Use the service only to transfer files you are allowed to share.
- Keep capability links and passwords confidential.
- Do not attempt to bypass the operator gate, rate limits, or capability checks.
- Do not probe, scrape, or overload the service.
- Comply with the Acceptable Use Policy and all applicable law.
- If you upload (the operator) or redistribute (a recipient) personal data of others, you must have a lawful basis to do so.
6. Files and licence to host
You retain whatever rights you already have in the files. You grant the provider a limited, non-exclusive licence to store, transmit, checksum, promote, preview (for allow-listed raster types), and delete the files solely to operate the transfer you requested, including cleanup after expiry or revoke. That licence ends when the objects are removed.
There is no extension or MIME denylist. Executables, scripts, archives, and documents may be uploaded. Preview never uses SVG. Download is served as an attachment.
7. Expiry and deletion
Transfers expire within 7 days. The visible default is 7 days and is also the maximum. There is no unlimited retention. Authorization ends at expiry, recipient delete, or operator revoke. Physical removal follows the published cleanup SLA of 24 hours. A delayed storage lifecycle is only a safety net. We do not promise deletion timing shorter than that SLA.
8. Acceptable use and removal
We may refuse or revoke a transfer that appears to violate the acceptable use rules or the law. Reviewed removal revokes authorization and enqueues cleanup without exposing capability data. The notice procedure is described in the copyright and illegal-content notice.
9. No warranty; no malware-scanning promise
The service is provided as-is and as-available. There is no warranty of availability, fitness, or uninterrupted access. There is no malware-scanning promise. There is no claim that files are encrypted end-to-end. There is no claim that recipients are anonymous. Preview, where offered, is original bytes without a transcode path; it is not a safety review of the file.
10. Availability and changes
We may change, suspend, or discontinue the service, including for maintenance, abuse, cost, or law. Unpublished size and file-count caps may be enforced. Rate limits may return “Try again later.” We may update these Terms. The effective date at the top is the current version. Continued use after publication means you accept the updated Terms for later visits. Existing transfers remain subject to the expiry and deletion rules in force when they were created, unless a change is required by law.
11. Intellectual property in the tool
The provider owns or licenses the software, design, marks, and documentation of the service, except the files you upload and third-party marks of processors. You may not copy the service, scrape it, or use the name in a way that suggests sponsorship.
12. Liability
To the maximum extent permitted by law, the provider is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or substitute services, arising from the service or from files transferred through it.
If a mandatory rule (including EEA consumer law that cannot be waived) makes a limitation unenforceable, the provider’s aggregate liability for a claim is limited to the amount you paid to use the service in the twelve months before the claim. That amount is zero because the service is free.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under the law that applies to you.
13. Indemnity
You will indemnify the provider against claims, losses, and reasonable legal costs arising from files you upload or redistribute, from your breach of these Terms or the Acceptable Use Policy, or from your infringement of another person’s rights, except to the extent caused by the provider’s willful misconduct.
14. Third-party infrastructure
The service depends on Netlify (hosting), Supabase (EU database), and Cloudflare R2 (EU object storage). Their failures, lawful process, or policy changes may affect the service. Direct uploads and downloads use signed URLs to object storage. The provider does not proxy object bodies.
15. Governing law and disputes
These Terms are governed by the laws of Romania, without regard to conflict-of-law rules that would apply another system, except that EEA consumers keep any mandatory protections of the country of their habitual residence.
Courts of Romania have jurisdiction, again without prejudice to a consumer’s right to sue in the courts of that consumer’s habitual residence where the law so provides. Before filing, please write to alex.jungean@gmail.com.
16. Miscellaneous
If a provision is held unenforceable, the rest remains in force. These Terms, with the policies linked above and the legal notice, are the entire agreement for use of the service. Failure to enforce a provision is not a waiver. You may not assign these Terms. The provider may assign them in connection with a transfer of the service.
